Travelers’ Rights
Essential Rights under Decree-Law No. 17/2018 of March 8:
-
Travelers will receive all essential information about the package trip before entering into the respective contract.
-
There will always be at least one operator responsible for the proper performance of all travel services included in the contract.
-
Travelers are provided with an emergency telephone number or the contact details of a contact point where they can reach the organizer or the travel agency.
-
Travelers may transfer the package trip to another person, with reasonable prior notice and, where applicable, upon payment of additional costs.
-
The price of the package trip can only be increased in the event of specific cost increases (for example, the price of fuel), if that possibility is expressly provided for in the contract, and in any case, up to 20 days before the start of the package trip. If the price increase exceeds 8% of the price of the package, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in the event of a decrease in the relevant costs.
-
Travelers may terminate the contract without paying a termination fee and obtain a full refund of payments made in the event of a significant alteration to any of the essential elements of the package, except for the price. If, before the start of the package trip, the responsible operator cancels it, travelers are entitled to a refund and, where appropriate, compensation.
-
Travelers may terminate the contract without paying a termination fee before the start of the package in exceptional circumstances, for example, in cases of serious security problems at the destination that may affect the package trip.
-
Additionally, travelers may terminate the contract at any time before the start of the package trip by paying an appropriate and justifiable termination fee.
-
If, after the start of the package trip, it is not possible to provide significant elements of it as agreed, suitable alternatives must be offered to the traveler at no additional cost. The traveler may terminate the package travel contract without paying a termination fee if the services are not performed as stipulated in the contract, this non-conformity significantly affects the performance of the package, and the organizer does not remedy the situation.
-
Travelers are also entitled to a price reduction and/or compensation for damages in the event of non-performance or poor performance of the travel services.
-
The organizer must provide assistance if a traveler is in difficulty.
-
If the organizer or retailer is declared insolvent, payments will be refunded. If the organizer or retailer is declared insolvent after the start of the package trip, and if transport is included, travelers are guaranteed repatriation. Angra 2000 Viagens e Turismo Lda has subscribed insolvency protection with the Travel and Tourism Guarantee Fund.
-
Travelers may contact this entity or, if applicable, the competent authority (Turismo de Portugal, I.P., Rua Ivone Silva, Lote 6, 1050-124 Lisbon, Tel. +351 211 140 200 | Fax +351 211 140 830, info@turismodeportugal.pt) if services are denied due to the insolvency of Angra 2000 Viagens e Turismo Lda.
