General Terms

This program/catalog is the informational document in which these General Conditions are included, forming an integral part of it and constituting, in the absence of a separate document, the travel contract.

This information is binding on the agency unless all the following conditions are met simultaneously:

  • The program expressly provides otherwise;

  • The changes are insignificant;

  • Information about the change is provided to the traveler in a durable medium.

These General Conditions comply with the provisions of Decree-Law No. 17/2018 of March 8.

The General Conditions whose object is an Organized Trip or Related Travel Service included in this program, the corresponding standardized information sheets, and the particular conditions contained in the travel documentation provided to the Traveler at the time of booking constitute the travel contract binding the parties.


ORGANIZATION

1.1 The organization of the trips included in this brochure is by Angra 2000 Viagens e Turismo Lda, headquartered in Angra do Heroísmo, Taxpayer Number 512037221, with a fully paid share capital of €1,000,000.00, registered with the Commercial Registry of Angra do Heroísmo under No. 640, and registration No. 1993/08-10, phone +351 295 215 555 (national landline), email geral@angra2000.com.

1.2 The marketing of the trip is carried out by Angra 2000 Viagens e Turismo Lda, headquartered in Angra do Heroísmo, Taxpayer Number 512037221, with a fully paid share capital of €100,000.00, registered with the Commercial Registry of Angra do Heroísmo under No. 640, and registration No. 1993/08-10, phone +351 295 215 555 (national landline), email geral@angra2000.com.


REGISTRATIONS

At the time of registration, the Traveler must pay 30% of the service price, settling the remaining 70% 21 days before the start of the service. If the registration occurs 21 days or less before the start of the service, the total price must be paid at the time of registration. Angra 2000 Viagens e Turismo Lda reserves the right to cancel any registration whose payment has not been made under the above conditions. Reservations are subject to confirmation of all services by the suppliers.


INFORMATION UNDER LAW NO. 144/2015 OF SEPTEMBER 8

Under Law No. 144/2015 of September 8, as currently amended, the Traveler may resort to the following Alternative Dispute Resolution Entities:

i) Customer Ombudsman for Travel Agencies: www.provedorapavt.com
ii) Arbitration Commission of Turismo de Portugal: www.turismodeportugal.pt


COMPLAINTS

4.1 Any non-conformity in the execution of a travel service included in the organized travel contract must be communicated to the organizing or retail travel agency in writing or by other suitable means as soon as the non-conformity occurs, without undue delay.

4.2 The right to make complaints for the purpose of a price reduction or compensation for non-conformity of travel services included in the organized trip expires within 2 years.


LUGGAGE

5.1 The agency is responsible for luggage under the law.

5.2 The Traveler must make claims to the service provider at the time of loss, damage, or destruction of luggage.

5.3 For international transport, in case of luggage damage, the claim must be made in writing to the carrier immediately after verifying the damage, and at the latest within 7 days from delivery.

For mere delay in luggage delivery, the claim must be made within 21 days from the delivery date.

5.4 Submission of such a claim is essential to trigger the responsibility of Angra 2000 Viagens e Turismo Lda against the service provider.


LIMITS

6.1 The agency’s liability shall be limited to the maximum amount enforceable against the service providers under the Montreal Convention of May 28, 1999, on International Air Transport, and the Berne Convention of 1961 on Rail Transport.

6.2 Regarding maritime transport, the liability of travel agencies to their Travelers for transportation or accommodation services, where applicable, by maritime transport companies, in case of damage resulting from fraud or negligence, shall be limited to:

a) €441,436 in case of death or bodily injury;
b) €7,881 for total or partial loss or damage of luggage;
c) €31,424 for loss of a motor vehicle, including luggage contained therein;
d) €10,375 for loss of luggage contained in a motor vehicle, whether accompanied or not;
e) €1,097 for damage to luggage as a result of damage to the motor vehicle.

6.3 When applicable, travel agencies’ liability for deterioration, destruction, or loss of luggage or other items in tourist accommodation establishments while the Traveler is staying there is limited to:

a) €1,397 overall;
b) €449 per item;
c) The value declared by the Traveler for items deposited for safekeeping at the accommodation establishment.

6.4 The agency’s liability for non-physical damages is contractually limited to an amount equivalent to three times the price of the sold service.


RESERVATION AND CHANGE FEES

7.1 For each reservation, the following fees apply:
Reservation Fee: €20, non-refundable.

7.2 Change Fees: €20, non-refundable, per change (names, dates, type of apartment or room, trip, etc.).

Acceptance of such changes depends on acceptance and costs from the respective suppliers.


DOCUMENTATION

8.1 The Traveler must have in proper order their personal or family documentation (identity card, military documents, authorization for minors, visas, vaccination certificates, and others as required). The agency declines any responsibility for visa refusals or denied entry to the Traveler in a foreign country; all associated costs are the Traveler’s responsibility.

8.2 Travel within the European Union:
Travelers of any age moving within the EU must have their identification document (Passport; ID Card; Citizen Card).
For medical assistance, they must carry the European Health Insurance Card.
Non-EU nationals should consult specific information on necessary documentation with the embassies/consulates of their country of origin.

8.3 Travel outside the European Union:
Travelers of any age moving outside the EU must have their identification document (passport) and visa if required (check with the agency at the time of booking).
